Prohibited actions of collection agencies

In Kazakhstan, with the adoption of the Law on Collection Activities, numerous immoral methods of dealing with debtors have stopped. Methods of work of collectors in Almaty, Kazakhstan, in the past, collectors exerted pressure on debtors by threatening violence or destroying or damaging the borrower's property.

Legal assistance from Collectors

The actions of collection agencies that are not considered to be in good faith and therefore prohibited in particular are: 1). The use of other methods of interaction with the debtor and (or) his representative, and (or) a third party, not provided for by the Law on Collection Activities; 2). Dissemination of information discrediting the honor, dignity and business reputation of the debtor and his representative, or disclose information that may cause them property damage; 3). The commission of unlawful acts that infringe on the rights and freedoms of the debtor and his representative, endanger their life and health, as well as cause them property and other harm; 4). Exerting pressure by threatening to use violence or destroying or damaging the property of the debtor and (or) his representative and (or) third parties, insults, fraud, forgery of documents, blackmail, forcing the debtor to fulfill obligations under a bank loan agreement or a micro-loan agreement;

To bring to justice and punish collectors

5). Misleading the debtor or his representative about the amount, nature and grounds of the debt; 6). Accepting money (in cash or non-cash form), as well as other property to repay debts; 8). The demand for repayment of debts with other property other than money; 9). Disclosure of a secret protected by the laws of the Republic of Kazakhstan, obtained from the creditor and (or) his representative, and (or) third parties, except in cases provided for by the laws of the Republic of Kazakhstan. When executing clients' orders, our first responsibility is to eliminate conflicts of interest.
